Part I — Privacy Policy
1. Identity and Contact Details of the Data Controller
The data controller responsible for personal data collected via The Art Market Review website (theartmarketreview.com) is:

CB PARIS has not appointed a Data Protection Officer (DPO) within the meaning of Article 37 of the GDPR, as its structure and processing volumes do not make such appointment mandatory. Any request relating to the protection of personal data may nonetheless be addressed to the contact above.
2. Data Collected, Purposes, and Legal Bases
2.1 Email addresses collected via the subscription form (Kit / ConvertKit)
CB PARIS collects the email addresses of visitors who voluntarily subscribe to its mailing list via the forms available on the site. These forms are operated by Kit (formerly ConvertKit).
Data: Email address
Purpose: Sending the newsletter and editorial communications related to The Art Market Review; sending information about available products
Legal basis: Consent of the data subject (Art. 6.1.a GDPR)
Consent is collected at the point of subscription via an explicit checkbox or action button. It is freely given, specific, informed, and unambiguous. It may be withdrawn at any time, without affecting the lawfulness of processing carried out prior to withdrawal.
CB PARIS does not collect any other personal data through its own forms. It has no access to payment data, which is collected and processed exclusively by Lemon Squeezy Inc. in its capacity as Merchant of Record.
2.2 Navigation data and analytics cookies
To the extent that CB PARIS uses audience measurement or navigation tracking tools (see Section 7 below), navigation data may be processed. The applicable legal basis depends on the nature of the tool used:
— If the tool falls within the category of solutions exempt from consent under the CNIL's guidelines (strictly anonymised audience analytics, without transfer of data outside the EU), the legal basis is CB PARIS's legitimate interest (Art. 6.1.f GDPR).
— In all other cases, processing is subject to the user's prior consent (Art. 6.1.a GDPR), collected via the cookie banner displayed on the first visit.
3. Retention Periods
Data: Email address (mailing list)
Retention: Until consent is withdrawn by the data subject, or until three (3) years of inactivity (no email opens) from the date of the last active interaction
Data: Navigation data (if collected)
Retention: As defined by the tool used, within a maximum of thirteen (13) months in accordance with CNIL recommendations
Upon expiry of these periods, data is deleted or irreversibly anonymised.
4. Transfers of Data Outside the European Union
Kit (ConvertKit, Inc.) is a company incorporated under the laws of the United States whose servers may process data outside the European Union, including in the United States.
This transfer is governed by the standard contractual clauses adopted by the European Commission pursuant to Article 46.2.c of the GDPR, which Kit declares to incorporate into its data processing agreements with clients established in the European Union. CB PARIS has entered into a Data Processing Agreement with Kit in compliance with GDPR requirements.

CB PARIS draws the attention of data subjects to the fact that, notwithstanding these contractual safeguards, data transferred to the United States may remain subject to applicable US legislation, including as regards access by public authorities.
5. Rights of Data Subjects
In accordance with Articles 15 to 21 and 77 of the GDPR, every data subject has the following rights:
Right of access (Art. 15 GDPR): to obtain confirmation that data concerning them is being processed and, where applicable, to receive a copy.
Right to rectification (Art. 16 GDPR): to have inaccurate or incomplete data corrected.
Right to erasure (Art. 17 GDPR, "right to be forgotten"): to obtain deletion of data in the cases provided for by the regulation.
Right to data portability (Art. 20 GDPR): to receive data provided in a structured, commonly used format, where processing is based on consent.
Right to object (Art. 21 GDPR): to object to processing based on legitimate interest, on grounds relating to the data subject's particular situation.
Right to restriction of processing (Art. 18 GDPR): to obtain restriction of processing under the conditions provided for by the regulation.
Right to withdraw consent: to withdraw consent at any time, without affecting the lawfulness of prior processing. Withdrawal may be effected by clicking the unsubscribe link in any email, or by contacting contact@theartmarketreview.com.
How to exercise these rights: Any request should be sent by email to contact@theartmarketreview.com, specifying the right being exercised and including any information enabling verification of the requester's identity. CB PARIS undertakes to respond within one (1) month of receipt, which may be extended by a further two months in the case of complex or multiple requests, in accordance with Article 12.3 of the GDPR.
6. Right to Lodge a Complaint with a Supervisory Authority
Every data subject has the right to lodge a complaint with the competent supervisory authority. In France, this is the Commission nationale de l'informatique et des libertés (CNIL): www.cnil.fr
This right is without prejudice to any other administrative or judicial remedy.
7. Cookies
A cookie is a small text file stored on the user's device when visiting a website. CB PARIS may use the following categories of cookies:

Purpose: Session maintenance, basic security
Maximum duration: Session duration
Consent required: No
Category: Analytics cookies (audience measurement)
Purpose: Measuring traffic and navigation behaviour to improve the site
Maximum duration: 13 months
Consent required: Depends on the tool used (see Section 2.2)
CB PARIS does not use advertising cookies or profiling cookies for commercial targeting purposes.
Users may at any time configure, refuse, or delete cookies via the cookie management banner displayed on the first visit to the site, or via their browser settings. Refusing analytics cookies does not affect access to the site's content.
Part II — Content Terms of Use
These terms govern exclusively the usage rights attached to digital files acquired via The Art Market Review website. They do not constitute general terms and conditions of sale and do not create any sales relationship between CB PARIS and the buyer. The contractual sales relationship is governed exclusively by the general terms and conditions of Lemon Squeezy Inc., available on its website at the time of purchase.
8. Scope and Subject Matter
These terms of use apply to the following digital products distributed under The Art Market Review brand by CB PARIS:
— The Art Market Review Workbook: a strategic guide in PDF format for artists and professionals working in the contemporary art market.
— The Template Pack: a collection of professional document templates for editorial and commercial use in the art sector.
— The Combined Bundle: an offer grouping both products above.
These products constitute original works protected by copyright under applicable French and international intellectual property law. Downloading any file constitutes acceptance of these terms of use.
9. Licence Granted
CB PARIS grants the buyer a personal, non-exclusive, non-assignable, and non-transferable licence to use the acquired digital files, valid without time limitation. This licence is strictly attached to the individual or legal entity that completed the purchase and may not be assigned, sub-licensed, or transferred to any third party, whether for consideration or free of charge.
10. Permitted Uses
Under the licence granted, the buyer is authorised to:
— Access and consult the files on their own devices, in a reasonable number.
— Print the files for personal use or for internal professional use within the entity that made the purchase.
— Use the templates included in the Template Pack to produce documents for their own use or for client work, within the scope of a lawful professional activity.
11. Prohibited Uses
The following are expressly prohibited without the prior written authorisation of CB PARIS:
— Reselling or transferring the files, in whole or in part, whether for payment or free of charge.
— Redistributing the files in any form, including by sharing download links, forwarding by email to third parties, or making files available on a shared or public storage space.
— Publicly reproducing or publishing the files or their content on any medium, including websites, social media, or file-sharing platforms.
— Modifying the files for commercial purposes, meaning any adaptation, translation, transformation, or derivative exploitation for resale or external distribution.
— Extracting, reusing, or incorporating any part of the content — including texts, data, analytical frameworks, and visuals — into artificial intelligence systems, training datasets, language models, or any automated content processing system, for any purpose whatsoever.
Any breach of these terms may give rise to civil and criminal liability, including for copyright infringement under Articles L. 335-2 et seq. of the French Intellectual Property Code.
12. Intellectual Property
All elements comprising the products — texts, analyses, market data, methodologies, editorial structures, visuals, and layout — remain the exclusive property of CB PARIS / The Art Market Review. All rights reserved. The acquisition of a digital product confers no ownership rights over the work, nor any assignment of copyright to the buyer.
13. No Right of Withdrawal
The products offered by The Art Market Review are digital content not supplied on a tangible medium, made available by immediate download upon completion of the transaction.
In accordance with Article L. 221-28, 13° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to these products, provided that performance has begun with the consumer's prior express agreement and acknowledgement that they thereby lose their right of withdrawal. This express agreement is collected by Lemon Squeezy Inc. during the purchase process, before access to the download is made available.
For buyers acting in a professional capacity, the consumer right of withdrawal does not apply independently of the above provision.
